Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:  (a) On or about April 6, 2013, and at times prior thereto, the employer was engaged in well servicing operations including, but not limited to, fracturing operations where the employer failed to secure, restrain and/or anchor each section of high-pressure, rigid line from movement should the line fail. This exposed employees to the struck-by hazards from uncontrolled movement of the rigid lines at Well Polar Thomas, Pad 5-3, Wells 1H, 1H3 and 8H, approximately two miles east of 123rd Avenue NW on 48th Street NW near Epping, ND.  Abatement Note: Among other methods, feasible and acceptable abatement methods to correct the hazard would be for the employer to secure and/or restrain the open-end, bleed-off valve of discharge lines (pressure lines) from movement in accordance with (API) American Petroleum Institute Recommended Practice 54, Third Edition, (Recommended Practice for Occupational Safety for Oil and Gas Well Drilling and Servicing Operations), section 9.13 PRESSURE EQUIPMENT, subsection 9.13.3 Each section of a high-pressure rigid line should be secured using appropriate means to prevent movement should the line fail. Flexible high-pressure hoses should be properly secured to prevent unsafe movement. Other suspended hydraulic, air, or electrical lines should be appropriately secured.
