29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On April 05, 2013, an employee was applying caulking to a publicity sign at an approximate height of 10 feet above concrete ground level work while working outside the protective area of the work platform of a Skyjack scissor exposing him to a fall hazard.

29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions. On April 05, 2013, at this construction site an employee was applying acrylic silicone caulk without the use of gloves exposing the employee to direct skin contact to the hand.
