29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees.  a. On the third floor balcony where employees were using air actuated nail guns to install guardrails, eye protection was not used, thereby exposing employees to a struck-by hazard.

29 CFR 1926.404(f)(6): Grounding path. The path to ground from circuits, equipment, and enclosures shall be permanent and continuous.  a. At the temporary electrical receptacle, the ground prong was missing from the extension cord that employees were using to provide power for a circular saw, thereby exposing employees to a contact hazard.

29 CFR 1926.405(g)(2)(iv): Strain relief. Flexible cords shall be connected to devices and fittings so that strain relief is provided which will prevent pull from being directly transmitted to joints or terminal screws.  a. On the north side of the building where employees were using extension cords for power to a circular saw, the strain relief clamp was pulled away from the outer insulation of the cord, thereby exposing employees to a contact hazard.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. On the third floor balcony where employees were nailing lumber, fall protection was not used, thereby exposing employees to a fall hazard.
