29 CFR 1910.134(c)(2)(i): The employer determined that respirator use by employees was permissible and did not provide the employees with information contained in Appendix D of this section: (a) Wabash National Trailer Centers, Inc. @ 4780 Vasquez Blvd., Denver, CO 80216: On and before 4/5/13, the employer did not provide employees with information that is contained in Appendix D. Employees voluntarily wore 3M half-face, air purifying respirators equipped with P95 filters during mechanic job duties and activities associated with building fire clean-up.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user: (a) Wabash National Trailer Centers, Inc. @ 4780 Vasquez Blvd., Denver, CO 80216: On and before 4/5/13, the employer did not ensure that employees equipped with company supplied 3M half-face, air purifying respirators were medically capable to wear the respirators prior to use during mechanic job duties and activities associated with building fire clean-up.
