29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about April 5, 2013, employees were not wearing hard hats while working near the HydroMobile scaffold where there is danger from falling objects including, but not limited to cement blocks and masonry tools.

29 CFR 1926.451(g)(4)(vii): Each toprail or equivalent member of a guardrail system was not capable of withstanding, without failure, a force applied in any downward or horizontal direction at any point along its top edge of at least 100 pounds (445 n) or guardrail systems installed on single-point adjustable suspension scaffolds or two-point adjustable suspension scaffolds, and at least 200 pounds (890 n) for guardrail systems installed on all other scaffolds.  On or about April 5, 2013, unsecured pallets were used as a substitute for a guardrail system in various areas of the company's HydroMobile scaffold.

29 CFR 1926.451(g)(4)(ix): Midrails, screens, mesh, intermediate vertical members, soild panels, and equivalent structural members of a guardrail system were not capable of withstanding, without failure, a force to applied in any downward or horizontal direction at any point along the midrail or other member of at least 75 pounds for guardrail systems with a minimum 100 pound toprail capacity, and at least 150 pounds for guardrail systems with a minimum 200 pound toprail capacity:  On or about April 5, 2013, pallets leaned against the structure were used as a substitute for guardrails on the HydroMobile scaffold.

On or about April 5, 2013, employees were exposed to a fall hazard of more than 10 feet while performing masonry work from a HydroMobile scaffold, which was lacking guardrails in various portions of the scaffold.    b. On or about April 5, 2013, employees were exposed to a fall hazard of more than 10 feet while performing masonry work from a supported scaffold, which was lacking guardrails on the open ends of the scaffold platform.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  On or about April 5, 2013, employees had not been properly trained to recognize the hazards associated with the scaffold being used and to understand the procedures to control those hazards, as evident by missing and/or improper guardrails.  DeBello Masonry was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.454(a), which was contained in OSHA inspection number 313373102, citation number 1, item number 1b,  and was affirmed as a final order on June 23, 2013, with respect to a workplace located at 7305 Lynn Ave., Hamlin, WV, 25523.
