29 CFR 1910.266(d)(1)(iv): The employer did not assure that each employee who operated a chain saw wore ballistic nylon leg protection or other  leg protection which the employer had demonstrated provides equivalent protection:    (a) Kerless Knob, Richwood, WV:  An employee was felling trees using a Husqvarna 390XP chain saw and the employee was not wearing protective leg chaps, as determined on April 8, 2013.    (b) Kerless Knob, Richwood, WV:  An employee that aided in limbing trees using a chain saw was not wearing protective leg chaps, as determined on April 8, 2013.    ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED.

29 CFR 1910.266(h)(1)(vi): Each danger tree, including lodged trees and snags, were not felled or removed using mechanical or other techniques that minimize employee exposure before work is commenced in the area of the danger tree:    (a)  Kerless Knob, Richwood, WV:  A 19 inch diameter tree, cut by the feller, did not fall and was left standing on the stump. This danger tree was not felled or removed using mechanical means or other safe method.  While cutting a second tree approximately 10 feet away, the 19 inch diameter danger tree fell and struck the feller, as determined on April 8, 2013. 29 CFR 1910.266(h)(2)(vi):  For each tree that was to be felled the backcut did not include sufficient hingewood to hold the tree to the stump during most of its fall so that the hinge was able to guide the tree's fall in the intended direction:    (a)  Kerless Knob, Richwood WV:  A 19 inch diameter tree was cut without leaving hingewood.  The tree remained on the stump after the backcut was made and shortly after fell sideways, away from the notch cut, and struck the feller approximately 10 feet away, as determined on April 8, 2013.    (b)  Kerless Knob, Richwood, WV:  The feller was cutting trees without leaving any hingewood to keep the tree attached to the stump to guide its fall in the direction of the notch cut as evidenced by approximately nine tree stumps observed in the immediate area of where the feller last operated, as determined on April 8, 2013.    ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED
