The employer shall use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductor:    On or about 4/08/2013, Halstead Ave.    a) The employees were using a skilsaw to cut plywood. They were not using a ground fault circuit interrupter.

29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets:    On or about 4/08/2013, Halstead Ave.    a) The laborers were not wearing hard hats. They were assisting the other employees on the roof.                                                              REPEAT VIOLATION    The Ed Brothers Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.100, which was contained in OSHA inspection number 312999394, citation number 2, item number 1 and was affirmed as a final order on 5/12/10, with respect to a workplace located at 516 Tarrytown Rd., White Plains, NY.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.    Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    On or about 4/8/2013, Halstead Ave.    a) There was one employee on the roof without a harness. The other three all had harnesses on but two of them were not tied off.                                                               REPEAT VIOLATION    The Ed Brothers Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 312999394, citation number 2, item number 2 and was affirmed as a final order on 5/10/2012, with respect to a workplace located at 516 Tarrytown Rd, White Plains, NY.
