29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  SHOP AREA:  On or about April 10, 2013, the employer had not developed or implemented a hazard communication program.  Chemicals used at the facility include methanol-based windshield washer fluid, antifreeze, transmission fluid, oil, and welding rods 7018 and 6013.

29 CFR 1910.1200(f)(5): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged, or marked with the identity and appropriate hazard warnings regarding the chemicals contained therein:  SERVICE BAYS:  On or about April 10, 2013, unlabeled 55-gallon drums reported to contain antifreeze, transmission fluid, and oil were observed.  Additionally, waste oil tanks were not labeled and there was an unlabeled 1-gallon Poland Spring water bottle with a clear yellow liquid reported to be coolant.

Chemicals used at the facility include, but are not limited to: NAPA Battery Terminal Cleaner, NAPA Open Gear Lube, NAPA Silicone Spray, Master DOT-3 Brake Fluid.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  SERVICE AREA:  On or about April 10, 2013, employees were expected to use various chemicals while servicing vehicles.  Information and training pertaining to the use of those chemicals and their potential hazards were not provided prior to use.  Chemicals used at the facility include, but are not limited to: NAPA Battery Terminal Cleaner, NAPA Open Gear Lube, NAPA Silicone Spray, Master DOT-3 Brake Fluid, motor oil, transmission fluid, and methanol-based windshield washer fluid.
