29 CFR 1926.451(g)(1)(ii): Two employee's working on a two-point light duty, rope suspension scaffold were not protected by both a personal fall arrest system and a guardrail system:      Location: 37 West 116 Street New York, NY, Rear of building, North East Corner.    On or about April 8, 2013    a) An employee was standing on top of the guardrail system while working 4 stories above the roof top below on a light duty two point suspended scaffold. Although wearing PFAS he was not tied off to any life line or scaffold rails.  By standing on the guardrail top rail he was now outside the protection zone. By not being tied off and by being outside the protection zone Employee was exposed to the hazard.

29 CFR 1926.451(g)(3)(iv): Vertical lifelines, independent support lines, and suspension ropes shall not be attached to each other, nor shall they be attached to or use the same point of anchorage, nor shall they be attached to the same point on the scaffold or personal fall arrest system.      Location: 37 West 116 Street New York, NY    On or about April 10, 2013, and other times prior thereto, at the above location,      a) Two employees were working on a light duty, two point suspended scaffold; the safety lines being used by the employees did not have an independent anchorage point. Both the tie back lines and the safety lines were anchored to the same point on the parapet clamps.

29 CFR 1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels sufficient to protect employees below.    Location: 37 West 116th Street, New York, NY 10026. Rear of Building     On or About 04/8/2013    a).  Employees were working on a light duty suspension scaffold 4 stories above the lower roof without having required toe boards, safety netting or barriers to prevent the accidential falling of objects from the scaffold system above to the street/surface below.  Although the employee working on the roof area below was wearing appropriate PPE (Hardhat) the exposure to the hazard was greater because no toeboards were installed.

Location: 37 West 116 Street New York, NY, rear of building.     On or About April 8, 2013, and other times prior thereto, at the above location,          a) Two employees were working on a light duty, two point suspended scaffold and were not trained to recognize hazards and to understand the procedures to control or minimize those hazards.  Employees worked on the scaffold which did not independent anchorage for personal fall arrest system, the scaffold did not have a toeboard and an employee stood on the guardrail system.
