OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to the hazards associated with being crushed or struck by falling objects:      West Terminal, Freezer #1:      The storage rack system used to store pallets of frozen food products including cranberries, seafood and turkeys, was not installed so as to prevent damage or collapse of the racks.   Deficiencies included, but were not limited to:  a) Bottom portions and other sections of the racks were damaged or significantly bent in locations such as Columns #17, #32 and other columns in D Aisle.

29 CFR 1910.176(b): Material stored in tiers was not stacked, blocked, interlocked or limited in height so that it was stable and secure against sliding and collapse:   Maritime Terminal:   In the following areas, stored materials were not stacked, blocked and/or limited in height so that they were stable against sliding and collapse:   a) Room #1- the pallet on the second tier of bagged frozen seafood was damaged.  b) Room #4 - one stack of boxes of frozen scallops was stacked 6 pallets high and was leaning significantly.  Another unstable stack was 4 pallets high of boxed frozen seafood.  The pallet of the second tier was damaged causing instability.

29 CFR 1910.304(f)(1)(iv): Overcurrent devices for circuits rated 600 volts, nominal, or less, were not readily accessible to each employee or authorized building management personnel and were located where they were exposed to physical damage:   West Terminal, Powerhouse Engine Room:   Disconnects for equipment such as CB #4 Unit #2 North and CB #1Unit #4 East were used to store personal protective equipment such a mask and face shield. A desk with combustible materials on its surface such as blueprints and cardboard boxes were located immediately in front of two of the disconnects.
