29 CFR 1910.23(e)(1): A standard railing did not consist of top rail, intermediate rail, and posts, and did not have a vertical height of 42 inches nominal from upper surface of top rail to floor, platform, runway, or ramp level. The intermediate rail was not approximately halfway between the top rail and the floor, platform, runway, or ramp. On 4/11/2013, employees working at Gamblin Lumber located at 1006 Peach Street, Poplar Bluff, MO, 63901, were exposed to a fall hazard. The storage loft in the warehouse was missing an intermediate rail halfway between the top rail and the flooring/platform.

On 4/11/2013, employees working at Gamblin Lumber located at 1006 Peach Street, Poplar Bluff, MO 63901, were operating forklifts without having completed the required refresher training. The operators had attended training in July 13, 2008, but had not completed the 3 year refresher training/evaluation since.

29 CFR 1910.178(p)(1): A powered industrial truck was found to be in need of repair, defective, or in any way unsafe, the truck and was not be taken out of service until it had been restored to safe operating condition. On 4/11/2013, employees working at Gamblin Lumber located at 1006 Peach Street, Poplar Bluff, MO 63901, were exposed to struck-by hazards. The company utilizes three forklifts during daily operations. The following defective forklifts were on site: 1. Red 5.4K Tailift forklift, model FD 35 & serial # 316751B, had a defective/inoperable horn. 2. Green 8K Mitsubishi Lift Truck, model FD 30K & serial # AF14C35206 had a defective/inoperable horn and reverse warning signal. 3. Yellow 6K forklift, serial # 7BM00686, had a defective/inoperable horn and reverse warning signal.
