29 CFR 1926.652(a)(1)(ii): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:     Excavations are less than 5 feet (1.52 m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in.   a.  Located at the corner of Groveport Pike and West Street in Canal Winchester, Ohio, there were employees installing a 6 inch water line in a trench with a maximum depth of 6 feet, 10 inches without any means of cave-in protection, thereby exposing the employees to the hazards associated with a trench cave-in.
