The employee was exposed to a struck-by hazard.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.   1) Walton on the Chattahoochee Apartments (Building 2000) - Employees were installing roof shingles about 22 to 25 feet high on a 6 in 12 slope without tying off with conventional fall protection.  Employees were wearing safety harnesses but were not tied off on the roof.     2) Walton on the Chattahoochee Apartments (Building 3700) - Employees were installing roof shingles about 17 to 20 feet high on a pitch roof ranging from a 4 in 12 to 8 in 12 slope without being tied off with conventional fall protection.  Employees were wearing safety harnesses but were not tied off on the roof. Employees were exposed to a fall hazards.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:(a)  a) Walton on the Chattahoochee Apartments - Employees were using a 30 foot Werner ladder to access the upper level of the roof.  The ladder did not extend at least 3 feet above the landing or tied to the building to prevent displacement.
