Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees: a) Warren County, Well site-M4 located off Mohawk Avenue. On or about November 15, 2012, employees were exposed to struck-by and/or crushing hazards from service rig instability, derrick failure or collapse due to guywires that were not erected and/or installed. The service rig was being utilized for operations on the well without forward guy wires being erected out over the front of the service rig.

29 CFR 1910.22(c): Covers and/or guardrails were not provided to protect personnel from the hazards of open pits: a) Well site-M4, area surrounding the waste water pit. On or about November 15, 2012, the area around the waste water pit was not guarded to prevent personnel from falling into the pit. Employees walked and worked in and around the pit area.
