29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) 2nd floor, south side: Two employees walked and worked at unprotected interior edges of the 2nd floor metal decking without fall protection. On or about 04/11/13. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces shall be protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes. a) 2nd floor, south side: Two employees walked/worked near a floor hole adjacent to them to get to the 2nd floor metal decking to work. The floor hole is 11 feet above the 1st floor level, and employees were not protected by personal fall arrest systems, covers, or guardrail systems erected around the hole. On or about 04/11/13. Note: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification of abatement for this violation as normally required by 29 CFR 1903.19.
