Where wet processes were used, drainage was not maintained, and false floors, platforms, mats, or other dry standing places were not provided when practicable:    On or about April 5, 2013 and at times prior thereto, the bin washing area was not kept clean and drainage of the pit was not maintained, resulting in stagnant water that can harbor mosquitoes and/or other pests, exposing employees to an unsanitary condition.

29 CFR 1910.23(a)(9): Every floor hole into which persons cannot accidentally walk (on account of fixed machinery, equipment, or walls) shall be protected by a cover that leaves no openings more than 1 inch wide. The cover shall be securely held in place to prevent tools or materials from falling through.  On or about April 5, 2013 and at times prior thereto, the grating in the bin washing area had openings of more than 1 inch, exposing employees to the hazards of slip, trips, and falls.

29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:     a)  A grinder operator was exposed to continuous noise at 193.3% of the permissible daily noise exposure (8-hour Time Weight Average sound level of 85 dBA) during the 347 minute sampling period on May 8, 2013.  For a full eight hour work shift this exposure would be equivalent to an average sound level of 94.8 dBA.  Exposure calculations included a zero increment for the 133 minutes not sampled.      a)  An extruder technician was exposed to continuous noise at 55.6% of the permissible daily noise exposure (8-hour Time Weight Average sound level of 85 dBA) during the 317 minute sampling period on May 8, 2013.  For a full eight hour work shift this exposure would be equivalent to an average sound level of 85.7 dBA.  Exposure calculations included a zero increment for the 163 minutes not sampled.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:     a)  On or about April 5, 2013, and at times prior thereto, employees operating a job made plastic bin cutter had an unguarded STIHL Chainsaw with a Dayton Industrial Motor, exposing employees to the hazard of being struck by the chainsaw blade.     b)  On or about April 5, 2013, and at times prior thereto, employees operating a job made Milwaukee Router Motor with a jig saw, exposing employees to the hazard of being struck by the unused portion of the blade.      c)  On or about April 5, 2013, and at times prior thereto, employees cutting plastic with a Delta Band Saw did not have the unused portion of the blade guarded, exposing employees to the hazard of being struck by the blade.       d)  On or about April 5, 2013, and at times prior thereto, employees cutting plastic with a JET Band Saw did not have the unused portion of the blade guarded, exposing employees to the hazards of being struck by the blade.      e) On or about April 5, 2013, and at times prior thereto, employees cutting plastic with a MSC Band Saw did not have the unused portion of the blade guarded, exposing employees to the hazard of being struck by the blade.     f) On or about April 05, 2013, and at times prior there to, employees operating a job made vacuum forming machine for the production of trash liners did not have guards in place to protect employees from rotating and moving parts, exposing employees to the hazards of being caught in moving parts.
