OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards caused by a falling load of steel pipe: a) Steel Pipe Staging Area, Route 67, Ballston Spa - On and prior to April 13, 2013, employees were exposed to struck by hazards due to working in the proximity of a suspended load of pipe with tag lines attached to the pipe hooks guide handles instead of the load. b) Steel Pipe Staging Area, Route 67, Ballston Spa - On and prior to April 13, 2013, employees were exposed to struck by hazards due to working in the proximity of a suspended load of pipe and not following manufacturer's recommendation for the pipe hooks in use. Caldwell Pipe Hooks (Model PH 4, Serial # 10-30874) positioned at the ends of the pipe were not used at the required minimum horizontal angle of 45 degrees (from the pipe to the wire sling leg).
