29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes:   a) Fourth floor stair access - Employees were not protected from falling through holes on the walking working surface while working on the fourth level.  This condition exposed employees to a fall hazard of approximately forty (40) feet.  Observed on or about April 9, 2013.   b) Third floor elevator shaft - Employees were not protected from falling through holes on the third level while accessing the fourth level.  This condition exposed employees to a fall hazard of approximately thirty (30) feet.  Observed on or about April 9, 2013.   c) Second floor elevator shaft - Employees were not protected from falling through holes on the second level while accessing the third level.  This condition exposed employees to a fall hazard of approximately twenty (20) feet.  Observed on or about April 9, 2013.   d) First floor elevator shaft -Employees were not protected from falling through holes on the first level while accessing the second level.  This condition exposed employees to a fall hazard of approximately fifteen (15) feet.  Observed on or about April 9, 2013.  e) Fourth floor staircase opening - Employees were not protected from falling through a staircase opening on the walking working surface while working on the fourth level.  This condition exposed employees to a fall hazard of approximately twenty (20) feet to the second floor.  Observed on or about April 9, 2013.  f) Third floor staircase opening - Employees were not protected from falling through a staircase opening on the third floor while accessing the fourth level.  This condition exposed employees to a fall hazard of approximately eight (8) feet to the second floor.  Observed on or about April 9, 2013.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, or an alternative fall protection measure that meets a provision described in paragraph (b) of 29 CFR 1926.501:    a) Fourth floor of building - Employees constructing a fourth floor outer wall were exposed to a fall hazard of approximately twenty-seven (27) feet without the use of conventional or alternative methods of fall protection.  Observed on or about April 9, 2013.

Observed on or about April 9, 2013.  b) Second floor of building - A stair rail system was not installed along unprotected sides of stairs containing approximately 2 sets of seven (7) risers, exposing employees to a fall hazard.  Observed on or about April 9, 2013.

Observed on or about April 9, 2013.  b) Garage area - While walking near an unprotected side employees were exposed to a fall hazard of ten (10) feet without the use of conventional fall protection.  Observed on or about April 9, 2013.

29 CFR 1926.1053(b)(4): Ladders were not used for the purpose for which they were designed:   a) Access from fourth floor to third floor of building - The portable A-frame ladders being used to access the working levels were not used as they were designed, exposing employees to a fall hazard.  The A-frame ladders were being used in a folded position and not opened according to the manufacturer's specifications.  Observed on or about April 9, 2013.
