29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: The employer does not ensure that employees are protected from falling while on working surfaces at heights greater than six feet. This violation was observed on or about April 12, 2013, when an employee was exposed to a fall hazard while painting a fence that surrounded an air conditioning unit next to the edge of the roof without any means of fall protection. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees performing construction activities at heights greater than six feet are protected from falling.
