Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from an elevated platform:    a) Warehouse- On or about 4/10/13, in order to pull and store merchandise from elevated storage racks, employees used a Yale powered industrial truck with a wooden platform on the forks without appropriate fall protection.  The employees were exposed to a fall hazard of approximately 7 feet to the ground when standing on the wooden pallet and approximately 8 feet, 6 inches to the ground stepping off the raised platform to reach the top tier of the rack system.  The employer did not ensure that additional precautions for the protection of employees were followed when the employees used a truck to elevate personnel. An employee fell from the elevated platform sustaining serious injuries which days later resulted in a fatality.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.36(d)(1): Employees were not able to open an exit route door from the inside at all times without keys, tools, or special knowledge.     a) Southeast Corner - The door marked exit located in the southeast corner of the warehouse was padlocked shut creating an entrapment hazard, on or about 04/10/13.     b) East Wall - The door marked exit located on the east wall of the warehouse was padlocked shut, creating an entrapment hazard, on or about 04/10/13.     c) North Wall - The door marked exit located in the north wall of the second warehouse was padlocked shut, creating an entrapment hazard, on or about 04/10/13.     d) East Side - The outside gate which would be used as exit discharge on the east side of the warehouse is locked and employees do not have access to free space away from the building in the event of a fire creating an entrapment hazard, on or about 04/10/13.     Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. 29 CFR 1910.37(a)(3): Exit routes must be free and unobstructed.     a) Southeast Corner - The exit  route in the southeast corner of the warehouse was blocked with boxes and pallets , on or about 04/10/13.   b) East Side - The exit route located on the east side of the warehouse was blocked with boxes and pallets, on or about 04/10/13.    c) North Wall - The exit route located on the north wall of the warehouse across the street was blocked with boxes, on or about  04/10/13.   d) East Side - The exit discharge on the east side of the warehouse is blocked and locked and employees do not have access to free space away from the building in the event of a fire creating an entrapment hazard, on or about 04/10/13.       e) East Side - On the east side of the warehouse the exit discharge is overgrown with vegetation and employees do not have access to free space away from the building in the event of a fire creating an entrapment hazard, on or about 04/10/13.
