29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions: West Coast World War II Memorial at Kobbe Avenue and Washington Street in the Presidio Trust: On or about April 09, 2103 and at times prior thereto, the employee operating the Caterpillar 304 (CAT10304CVFPK05155) Mini Hydraulic Excavator was not wearing a seat belt while operating the earthmoving equipment.

29 CFR 1926.601(b)(14): All vehicles in use shall be checked at the beginning of each shift to assure that the following parts, equipment, and accessories are in safe operating condition and free of apparent damage that could cause failure while in use: service brakes, including trailer brake connections; parking system (hand brake); emergency stopping system (brakes); tires; horn; steering mechanism; coupling devices; seat belts; operating controls; and safety devices. All defects shall be corrected before the vehicle is placed in service. These requirements also apply to equipment such as lights, reflectors, windshield wipers, defrosters, fire extinguishers, etc., where such equipment is necessary: West Coast World War II Memorial at Kobbe Avenue and Washington Street in the Presidio Trust: On or about April 09, 2103 and at times prior thereto, there were no daily inspections conducted on equipment including but not limited to the Caterpillar 304 (CAT10304CVFPK05155), the Bobcat T250 (531811202), the Bomag BW 120 AD-3 (101170512317), and the Caterpillar CP-323C (CATCP323CEAS00334).
