29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladders length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigied support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. Worksite: The extension ladder that was used to gain access to the roof at a height of approximately 26 feet above the ground did not have its side rails extended 3 feet above the landing surface.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired. Worksite: The extension ladder that was used by employees to gain access to the roof at a height of approximately 26 feet above the ground was defective and not taken out of service.
