29 CFR 1926.1101(g)(7)(i): All Class II work was not supervised by a competent person as defined in 29 CFR 1926.1101(b): At the residential construction site located at 5315 Aurora Drive in Austin, Texas, on or about March 21, 2013 and at times prior thereto, where employees were engaged in renovation operations that included stripping presumed-asbestos-containing shingles/siding and cleaning up debris, the work was not supervised by a person who was capable of identifying existing asbestos hazards in the workplace and selecting the appropriate control strategy for asbestos exposure, who had the authority to take prompt corrective measures to eliminate asbestos hazards, and who was specially trained in a training course which met the criteria of EPA's Model Accreditation Plan (40 CFR part 763) for supervisor, or its equivalent. Amended water was not used to thoroughly wet each piece of siding, and waste shingles/siding was placed in unlabeled black drawstring garbage bags for disposal in the landfill.

29 CFR 1926.1101(l)(2): Asbestos waste, scrap, debris, bags, containers, equipment, and contaminated clothing consigned for disposal was not collected and disposed of in sealed, labeled, impermeable bags or other closed, labeled, impermeable containers: At the residential construction site located at 5315 Aurora Drive in Austin, Texas, on or about March 21, 2013 and at times prior thereto, where employees were engaged in renovation operations that included stripping presumed-asbestos-containing shingles/siding, asbestos waste, scrap, and debris were placed in black waste bags in lieu of containers that were labeled in accordance with paragraph (k)(8)(iii) or (iv) of this section.
