29 CFR 1910.272(j)(2)(ii):  The employer shall immediately remove any fugitive grain dust accumulations whenever they exceed 1/8 inch (.32 cm) at priority housekeeping areas, pursuant to the housekeeping program, or shall demonstrate and assure, through the development and implementation of the housekeeping program, that equivalent protection is provided:     a.  In the basement of the South Mill, fugitive grain dust accumulations of .140 to 5 inches which had covered areas such as the floor surfaces, pit floor, floor ledges, wall ledges, stair steps, section of pipe on floor, base of support column, boot for South leg, South pit auger, wood surfaces, U-trough, and snap switch for lights were not immediately removed.     b.  In the basement of the South Mill Mixer Area, fugitive grain dust accumulations of .148 to 6 inches which had covered areas such as the floor surfaces, steps on stepladder, duplex receptacle on column near new leg, unused Prater grinder, disconnect for molasses pump, wooden wall ledges, concrete ledge, horizontal board on column, disconnect for corn auger motor, motor for unused grinder, floor of electrical room, and floor of freight elevator were not immediately removed.

29 CFR 1910.307(c):  Electrical installations.  Equipment, wiring methods, and installations of equipment in hazardous (classified) locations shall be intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location.  Requirements for each of these options are as follows:    a.  In the basement of the South Mill, electrical equipment including a snap switch for lights in a Class II, Division 1 location was not intrinsically safe, approved for a Class II, Division 1 location, or safe for a Class II, Division 1 location.    b.  In the basement of the South Mill Mixer Area, electrical equipment including, but not limited to, the duplex receptacle on the column near the new leg, disconnect for the molasses pump, and disconnect for the corn auger motor in a Class II, Division 1 location was not intrinsically safe, approved for a Class II, Division 1 location, or safe for a Class II, Division 1 location.    c.  In the electrical room in the basement of the South Mill Mixer Area, electrical equipment including, but not limited to, the circuit breaker box for the office and a duplex receptacle with a heat tape cord plugged into the receptacle in a Class II, Division 2 location was not intrinsically safe, approved for a Class II, Division 2 location, or safe for a Class II, Division 2 location; or the electrical room was not reclassified as a non-hazardous location by providing positive pressure ventilation in conjunction with a self-closing door with seals and ensuring that the room was constructed to prevent the entrainment of grain dust.    d.  On the main floor of the South Mill, electrical equipment including, but not limited to, the fluorescent ceiling light plugged into an extension cord and duplex receptacle, incandescent light plugged into a duplex receptacle, 4-plex receptacle with a Bruchbuhler scale plugged into it, fluorescent ceiling light plugged into a duplex receptacle, disconnect for the exhaust fan, reset box for the South elevator leg, and a Power Twin vacuum (S/N:  3301) in a Class II, Division 2 location was not intrinsically safe, approved for a Class II, Division 2 location, or safe for a Class II, Division 2 location.    e.  In the electrical room on the second floor of the South Mill Mixer Area, electrical equipment including, but not limited to, the duplex receptacle and disconnect boxes/reset boxes for the new leg, corn leg, screw augers 1 and 3, grain screw auger, blue mixer, orange mixer, and crimper in a Class II, Division 2 location was not intrinsically safe, approved for a Class II, Division 2 location, or safe for a Class II, Division 2 location; or the electrical room was not reclassified as a non-hazardous location by providing positive pressure ventilation in conjunction with a self-closing door with seals and ensuring that the room was constructed to prevent the entrainment of grain dust.     f.  On the main floor of the South Mill Mixer Area, electrical equipment including, but not limited to, the radio and 25 foot extension cord plugged into the duplex receptacle in a Class II, Division 2 location was not intrinsically safe, approved for a Class II, Division 2 location, or safe for a Class II, Division 2 location.

All areas designated as hazardous (classified) locations under the Class and Zone system and areas designated under the Class and Division system established after August 13, 2007 shall be properly documented.  This documentation shall be available to those authorized to design, install, inspect, maintain, or operate electric equipment at the location:   a.  All areas designated as hazardous (classified) locations under the Class and Division system were not properly documented for the facility including, but not limited to, the following areas:  South mill basement, South mill main floor, South mill mixer area basement, South mill mixer area main floor, and South mill mixer area second floor.

At the West entrance to the South Mill, the employer did not have a combustible dust hazard sign to warn against potential deflagration and explosion hazards from grain dust atmospheres that may occur due to the handling of grain.   c.  At the West entrance to the South Mill Mixer Area, the employer did not have a combustible dust hazard sign to warn against potential deflagration and explosion hazards from grain dust atmospheres that may occur due to the handling of grain.   d.  At the North entrance to the South Mill Mixer Area, the employer did not have a combustible dust hazard sign to warn against potential deflagration and explosion hazards from grain dust atmospheres that may occur due to the handling of grain.

29 CFR 1910.1200(h)(1):  Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area.  Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals.  Chemical-specific information must always be available through labels and material safety data sheets:  a.  At the facility, the employer did not provide hazard communication training for employees who were exposed to hazardous chemicals such as gasoline, grease, 10W-40 oil, and Blaster.
