29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):     (a)  Keystone Diner, 6431 York Road New Oxford, PA - The employer did not conduct or document a personal protective equipment (PPE) assessment for employees who handle hazardous chemicals, including but not limited to Hypochlorite Solutions UN 1791 and Clorox bleach on a daily basis, thereby exposing employees to injuries, on or about April 16, 2013.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

An employee was struck by the falling grill and received fatal injuries, on or about April 16, 2013.    No abatement certification or documentation required.
