29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) First Story Floor, Front of the Building - on or about April 11, 2013 - Platform that measured 4 feet wide by 7 feet, 10 inches long was not equipped with a guardrail system. Elevation to the concrete basement slab was 16 feet, 5 inches. (b) First Story Floor Stair Opening - on or about April 11, 2013 - no guardrail system was installed for this opening. Wall opening was 10 feet 8 inches wide.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) First Story Floor, Front of the Building - on or about April 11, 2013 - the employer did not provide a comprehensive fall protection training program for the employees that were on site performing plumbing installations.
