This condition exposed the employee to the hazards of falling or struck-by from inadvertent operation and movement.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    On or about April 16, 2013, at the worksite located at or near Capital and Victory Streets, Little Rock, Arkansas, an employee working in an excavation approximately 12-15 feet in depth was not protected by an adequate protective system. A metal trench box was installed in the lower section of the excavation and the upper approximate six (6) feet of the excavation was not protected. Additionally, the walls of the excavation had been deeply undercut, leaving a large amount of unsupported soil and concrete above the trench. This condition exposed the employee to the hazards of being struck-by or engulfed in soil and/or concrete in the event of a cave-in or collapse of the trench walls.
