29 CFR 1926.451(f)(3):  Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:    (a)  Brothers Masonry at 1690 Hwy 6 & 50, Fruita, CO 81521: On 4/10/13, the employer did not ensure the prefabricated scaffolding system had been inspected for visible defects by a competent person before use.  One subcontracting employee was working from the top plank of a prefabricated scaffolding system on the east side of the building.  The guardrails were not in place and there were no base plates to support the scaffolding.  This condition exposed the employee to an approximate 14 foot fall hazard.       Abatement Note:  Concerning the requirements and duties of a competent person:       (1)  "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.       (2)  The competent person must be able to carry out the tasks specified in the standard. In order to be able to carry out the tasks the competent person needs to have knowledge in the issues relating to the strength and structural integrity of the scaffold. A competent person must be fully knowledgeable about erecting, disassembling, moving, operating, repairing, maintaining and inspecting the scaffold.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds were not fully planked or decked between the front uprights and the guardrail supports:     (a)  Brothers Masonry at 1690 Hwy 6 & 50, Fruita, CO 81521: On 4/10/13, the employer did not ensure the working platform on the fabricated frame scaffold was fully planked in that only one plank was placed on the scaffold.  One subcontracting employee was working from the top plank of a prefabricated scaffolding system on the east side of the building.   This condition exposed the employee to an approximate 14 foot fall hazard.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, and uprights did not bear on base plates and mud sills or other adequate firm foundation:   (a)  Brothers Masonry at 1690 Hwy 6 & 50, Fruita, CO 81521: On 4/10/13, the employer did not ensure that supported scaffold poles, legs, posts, frames, and uprights were on base plates and mud sills or other adequate firm foundation.  One subcontracting employee was working from the top plank of a prefabricated scaffolding system on the east side of the building.  The scaffold poles were place on damp ground and did not have base plates or mud sills.  This condition exposed the employee to an approximate 14 foot fall hazard.

(a)  Brothers Masonry at 1690 Hwy 6 & 50, Fruita, CO 81521: On 4/10/13, the employer did not ensure that employees were protected from a fall from elevation in that guardrails or other suitable fall protection were not installed on the working platform of the scaffolding.  One subcontracting employee was working from the top plank of a prefabricated scaffolding system on the east side of the building.  The guardrails were not in place and there were no other means of fall protection.  This condition exposed the employee to an approximate 14 foot fall hazard.

29 CFR 1926.452(c)(2):  Frames and panels were not braced by cross, horizontal, or diagonal braces, or combination thereof, which secured vertical members together laterally:  (a)  Brothers Masonry at 1690 Hwy 6 & 50, Fruita, CO 81521: On 4/10/13, the employer did not ensure all brace connections were secured on the fabricated frame scaffold in use, in that cross braces on one side were missing on the top two levels of the scaffold.  One subcontracting employee was working from the top plank of a prefabricated scaffolding system on the east side of the building.   This condition exposed the employee to an approximate 14 foot fall hazard.
