29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Worksite, Lee Gray Court, Glen Cove, NY- Employees were working on a roof with a pitch of approximately 6/12, at a height of approximately 20 feet above the ground below without being protected from a fall; on or about 4/10/13.   Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a) Worksite, Lee Gray Court, Glen Cove, roof of residence- Employees were accessing the roof of a two story residence by way of an extension ladder which extended approximately one foot above the upper landing surface; on or about 4/10/13.  b) Worksite, Lee Gray Court, Glen Cove- roof of residence- Employees were accessing the roof of the garage attached to the residence by way of an extension ladder which extended approximately one foot above the upper landing surface; on or about 4/10/13.   Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  a) Worksite, Lee Gray Court, Glen Cove, NY- Employees using pneumatic nails gun to install plywood sheathing and roofing shingles to a residential roof were not wearing eye protection; on or about 4/10/13.  Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
