OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazards of being struck by moving vehicles which are causing or likely to cause death or serious physical harm to employees: This violation was observed on or about April 16, 2013 when the employer parked an Genie S-80 aerial lift on the right hand side of the roadway and allowed two (2) employees to work from it without protecting the Genie from vehicle traffic and not providing traffic control.
