OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by of falling load hazards: Frequent and periodic inspections were not performed on the Harrington 500 pound hoist. Employees were exposed to struck-by hazards associated with falling loads and/or an overloaded hoist. Among other methods, one feasible and acceptable abatement method is: Perform frequent and periodic inspections as required by ASME B30.16-2007 - OVERHEAD HOISTS, Section 16-2.1.2 and 16-2.1.3. Inspections include, but are not limited to, controls and operating mechanisms for improper operations; safety devices for malfunction; deterioration or leakage in air systems; and, deformations, chemical damage, or cracks in hook.
