OSH ACT of 1970 Section (5)(a)(1):    The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by of falling load hazards:     Frequent and periodic inspections were not performed on the Harrington 500 pound hoist.  Employees were exposed to struck-by hazards associated with falling loads and/or an overloaded hoist.    Among other methods, one feasible and acceptable abatement method is:    Perform frequent and periodic inspections as required by ASME B30.16-2007 - OVERHEAD HOISTS, Section 16-2.1.2 and 16-2.1.3.  Inspections include, but are not limited to, controls and operating mechanisms for improper operations; safety devices for malfunction; deterioration or leakage in air systems; and, deformations, chemical damage, or cracks in hook.

29 CFR 1910.147(c)(6)(ii): The employer did not certify that periodic inspections of the energy control procedures had been performed:  Employees performing servicing and maintenance operations were exposed to hazards associated with the unexpected energizing or start-up of the equipment such as but not limited to the Absolent Mist Collector machine; the Cecor Pump machine; the Citizen Lathes in that periodic inspections of all energy control procedures for equipment  were not performed nor documented.    29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.
