29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees. a. On the roof of the jobsite where employees were using air actuated nail guns to attach the roof sheathing, the employee's eyes were not protected by safety glasses, thereby being exposed to a struck-by hazard.

29 CFR 1926.405(g)(2)(iv): Strain relief. Flexible cords shall be connected to devices and fittings so that strain relief is provided which will prevent pull from being directly transmitted to joints or terminal screws. a. At the temporary electrical panel on the north side of the building where employees plugged in extension cords, the strain relief was pulled apart from the the outer insulation of the cord, thereby exposing employees to a contact hazard.

29 CFR 1926.503(c)(3):"Retraining." When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer shall retrain each such employee. Circumstances where retraining is required include, but are not limited to, situations where inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill. a. At the jobsite where employees were installing sheathing to the roof of the building, the employees did not know what personal protective equipment to wear and had not been retrained, thereby being exposed to a nine foot, nine inch fall hazard.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems. a. At the north side of the jobsite where employees were installing roof sheathing on the 6/12 pitch roof, fall protection was not used, thereby exposing employees to a 9 foot, 9 inch fall hazard. A & R Builders was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 312868391, citation number 1, item number 1 and was affirmed as a final order on February 11, 2009, with respect to a workplace located at 3215 E. 55 St. Cleveland, OH 44103.
