29 CFR 1903.19(d)(1): The employer did not submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required:  (a)    Fiberglass Custom Repair Center, Inc., failed to provide documentation demonstrating the abatement methods and completion as cited in Citation 1 and Citation 2 for hazards associated with; 1-1a) a written and implemented respiratory protection program including physical evaluations, fit testing and employee training; 1-1b) failure to provide a copy of Appendix D under 29 CFR 1910.134; 1-3) failure to provide a written hazard communication program including training; 2-2) no hazard assessment for personal protective equipment;  and 2-3) no documentation that a personal protective equipment assessment certification was conducted.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:     (a)  Where the employer provided and required the use of 3M Model 07192 half face respirators with P 95 Organic Vapor cartridges while spray painting boats, the employer did not establish and implement a written respiratory protection program, which included physical evaluations, fit testing and employee training.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
