29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    The employer does not protect employees from falling when working more than 10 feet above a lower level. This violation was observed on or about April 11, 2013 at the entrance to construction site where employees were exposed to fall hazards of more than 10 feet on a fabricated frame scaffold and were not protected by the use of  personal fall arrest systems or guardrail systems.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees using scaffolds more than 10 feet above lower levels are protected by the use of personal fall arrest systems or guardrail systems.

29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.  The employer does not protect  each employee on a scaffold from falling hand tools, debris, and other small  objects. This violation was observed on or about April 11, 2013 at the entrance to construction site where employees were exposed to a struck-by hazard when walking or working below employees who are working on the scaffold.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees working around scaffolds are provided with  protection from falling objects.
