29 CFR 1926.451(g)(3): In addition to meeting the requirements of 1926.502(d), personal fall arrest systems used on scaffolds shall be attached by lanyard to a vertical lifeline, horizontal lifeline, or scaffold structural member. Vertical lifelines shall not be used when overhead components, such as overhead protection or additional platform levels, are part of a single-point or two-point adjustable suspension scaffold: (a) Jobsite: On or about April 5, 2013, an employees fall protection equipment was not set up correctly in that excess slack was found in the rope. This would allow the employee to free fall approximately 12 feet to the ground below prior to the fall protection system activating.

29 CFR 1926.503(c)(3): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: (a) Jobsite: On or about April 5, 2013, an employee who was exposed to fall hazards while working from a pump jack scaffold needed to be retrained. The employee was tied off but he would have hit the ground before the fall protection system activated. In addition, this employee was using an aluminum extension ladder as a standard guardrail.
