At the east side of the building, employees were exposed to a 14 feet fall hazard, in that, the planking at the second frame platform of a tubular welded frame scaffold used to gain access to the roof did not extend at least 6 inches.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:   a. At the east side of the building, employees were exposed to a 19 feet fall hazard, in that, the scaffold frame and cross braces were used to gain access to the roof. The employees used a ladder to access the second frame and then climbed the third frame so that they can get on the roof.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level:     a. At the east side of the building, employees were exposed to a 14 feet fall hazard, in that, a tubular welded frame scaffold used to gain access to the roof did not have guardrails installed on all open sides. The scaffold was three frames high and an open sided platform was used at the second frame to access the roof.

29 CFR 1926.454(a):  The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards as required by paragraph (a)(1)-(5) of this section:       a. At the site, employees were gaining access to the roof by using a three frame scaffold where guardrails were not erected to protect employees from falling to the ground 14 feet below, the employees were climbing the third frame to access the roof which was 36 inches from the scaffold. Employees involved in scaffold use were not provided training and education in the following:     1. The nature of fall hazards and any falling object hazards.     2. The correct procedures for dealing with erecting, maintaining, and disassembling the fall protection system and falling object protection system being used.     3. The proper use of the scaffold, and the proper handling of material on the scaffold.     4. The maximum intended load and load carrying capacities of the scaffold.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards to enable them to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:     a. At the site, employees were working right at the edge of the roof during concrete grouting, without being protected from falling off the perimeter of the building by the use of a fall protection system. Employees would stand right at the edge of the building while pumping concrete. The employees were not trained in the following:     1. The nature of the hazards in the work area;     2. The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;     3. The use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, control access zone systems and other protection used;     4. The correct procedures for the handling and storage of equipment and materials;     5. The standards and requirements under 29 CFR 1926 Subpart M;
