29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by a guardrail system, safety net system, or personal fall arrest system, or an alternative fall protection measure that meets a provision described in paragraph (b) of 29 CFR 1926.501.      a)  800 North 48th Street, Philadelphia, PA-  Employees were exposed to fall hazards of approximately 20 feet from the second floor of a row of town homes under construction.  Employees traveled the entire length and width of the newly decked second floor staging prefabricated wall sections in preparation for the installation of the exterior walls without any means of fall protection.  Condition observed on April 3, 2013.       NOTE:  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.    a) 800 North 48th Street, Philadelphia, PA- Employees accessed the second floor via the stairwell in one of the center units of the row of new town homes.  The stairwell opening to the second floor was not provided standard guardrail to prevent employees from falling into the floor opening.  Condition observed on April 3, 2013.      Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards.     a) 800 North 48th Street- The employees exposed to fall hazards while framing the southern row of town homes, had not been provided training that enabled them to recognize fall hazards and the procedures to minimize the hazards.  Noted on April 4, 2013.       NOTE:  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. 29 CFR 1926.501(b)(14): The employer did not ensure that each employee working on, at, above, or near wall openings where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening was less than 39 inches (1.0 m) above the walking/working surface, were not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.      a) 800 North 48th Street, Philadelphia, PA - Employees were exposed to fall hazards in that the wall openings for the windows on the first floor of the south row of townhomes under construction were not provided any form of fall protection.  The sill height on the rough openings was 24 inches and was approximately 14 feet above the ground below.  Condition observed on April 3rd and 4th of 2013.      Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.1052(c)(1)(i): Stairways having four or more risers or rising more than 30 inches, whichever is less, were not equipped with one stairrail system along each unprotected side or edge:     a) 800 North 48th Street, Philadelphia, PA - Employees were exposed to falls on stairs in that the job-built stairwell in the unit used to access the second floor by the crew was not equipped with a stairrail system.  The two stair cases, ground floor to first floor and first floor to second floor, each rose approximately 10 feet with 13 risers.       Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
