29 CFR 1926.102(a)(1): Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents. On or about April 18, 2013, on the roof, the employer did not ensure an employee using a pneumatic nail gun was protected by the use of protective eyewear. The employee actively used the pneumatic nail gun on the day of this inspection while installing roof shingles on the building. This condition exposed the employee to serious eye injuries.

29 CFR 1926.502(d)(16)(iii): be rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level; On or about April 18, 2013, on the roof, the employer did not ensure an employee working at heights greater than approximately 9 feet, from edge of roof to the unfinished ground below, properly adorned his personal fall arrest system. An employee's harness was improperly positioned while installing roof shingles from edge to roof pitch on the northside of a 4:12 pitch roof. The harness rope grab was positioned on the lifeline in such a manner that the employee would free fall more than 6 feet (1.8 m) to the unfinished ground below.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. On or about April 18, 2013, on the roof, the employer did not provide training to an employee working at heights greater than approximately 9 feet from edge of roof to the unfinished ground below.
