29 CFR 1926.300(b)(2): Belts, gears, shafts, pulleys, sprockets, spindles, drums, fly wheels, chains, or other reciprocating, rotating or moving parts of equipment shall be guarded if such parts are exposed to contact by employees or otherwise create a hazard. Guarding shall meet the requirements as set forth in American National Standards Institute, B15.1-1953 (R1958), Safety Code for Mechanical Power-Transmission Apparatus.       a). On and times prior to 17 April 2013, there is a mixer drive shaft approximately 16 inches in length located on the auger side of the Strong Manufacturing Deckmate D2F Mixer (Serial #10-1525, Identification # 6009) that is not guarded, exposing employees to an in-running nip point hazard.

29 CFR 1926.1053(b)(7): Ladders shall not be used on slippery surfaces unless secured or provided with slip-resistant feet to prevent accidental displacement. Slip-resistant feet shall not be used as a substitute for care in placing, lashing, or holding a ladder that is used upon slippery surfaces including, but not limited to, flat metal or concrete surfaces that are constructed so they cannot be prevented from becoming slippery.     a). On or around 8 March 2013, an extension ladder with the bottom base sitting on top of a piece of plywood due to the wet roof surface slipped and fell while an employee was using it to gain access from the Fine Arts roof to the Gymnasium roof to tie off ladder, exposing the employee to a fall of approximately 15 feet back onto the Fine Arts roof.

29 CFR 1926.104: Note: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.134 of this chapter.     29 CFR 1910.134(c)(2)(i): An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard").   a). On and times prior to 17 April 2013, employees wearing 3M 8210 N-95 particulate respirators in a voluntary use capacity when operating the Strong Manufacturing Deckmate D2F Mixer (Serial # 10-1525, Identification #6009), was not provided the information contained in Appendix D of the regulation referenced above.
