29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees. a). On or about 17 April 2013, an employees arms and hands were not adequately protected from sparks generated while welding sock brackets to the I-beams inside the gymnasium while using a Lincoln Electric Power MIG welder (serial # M311092431), exposing the employee to burns. The employees bare arms were exposed and the employee wore gloves manufactured by Protective Industrial Products (model: Great White 19-D622) that were not designed to provide protection against welding sparks.
