29 CFR 1926.651(c)(2) Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:      (a)    Construction Site: On or about April 15, 2013, and at times prior thereto, employees were exposed to a cave-in hazard as they were placing cement forms around the outside East wall of the foundation. As the forms were put in place it required the employees to work alongside an excavated earth wall that was approximately 8 feet in depth.without any immediate means to escape.

29 CFR 1926.651(k)(2) Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:  (a)    Construction Site: On or about April 15, 2013, and at times prior thereto, employees were exposed to a cave-in hazard as they were placing cement forms around the outside North and East walls of the foundation. As the forms were put in place it required the employees to work alongside an excavated earth wall that was approximately 8 feet in depth.

All protruding reinforcing steel, onto and into which employees could fall, were not guarded to eliminate the hazard of impalement:  (a)    Construction Site: On or about April 15, 2013, and at times prior thereto, employees were exposed to impalement hazards of approximately 2 foot rebar protruding vertically out of the cement footings.
