29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a. On or about April 10, 2013, at The Yatch Garage facilities, Villa Marina, Fajardo, Puerto Rico. Employees engaged in painting and boating repairs/maintenance perations had been working with no safety shoes so as to protect them from injury. NOTE: Certification of abatement is not required for this citation item since it was submitted prior to citation issuance.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets. a. On or about April 10, 2013, at The Yatch Garage facilities, Villa Marina, Fajardo, PR. The employer did provide information and training to employees while utilizing hazardous chemicals such as paints and and other chemicals for employees engaged in painting and boats maintenance operations. NOTE: Certification of abatement must be submitted for this citation item as required by 29 CFR 1903.19(c).
