29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part:  a. On or about April 16, 2013, at the above addressed jobsite, a safety and health program, which would address those hazards associated with the employee's work environment and the company's procedures to eliminate exposure to those hazards, had not been developed and maintained.

On or about April 16, 2013, at the above addressed jobsite, safety inspections were not made by persons capable of identifying and correcting those hazards which could result in employee injuries.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure:  a. On or about April 16, 2013, at the above addressed jobsite, an employee working from the 7/12 pitched roof was exposed to falls of approximately 10' 8 " due to the lack of a fall protection system.
