1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one-half horizontal to one vertical: A) 50 Lyman Avenue, Staten Island, NY 10305: Employees were allowed to work in an excavation/trench that was 8'1"' long x 5'3"' wide x 6'1" deep with no cave-in protective system in place, i.e. trench shield, shoring, and or sloping in place to prevent collapse. Condition observed on or about April 17, 2013.
