29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.   a. On or about April 22, 2013, at the above located workplace, employees required to service semi-trucks were exposed to hazards associated with chemicals such as, but not limited to, use OReilly Diesel engine oil and OReilly GL-5 Gear lubrication. These hazards necessitated the use of personal protective equipment such as safety glasses and gloves. The employer had not verified, through written certification, that a hazard assessment had been performed.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:  a. On or about April 22, 2013, at the above located workplace, employees required to service semi-trucks were exposed to hazards associated with chemicals such as, but not limited to, use O'Reilly Diesel engine oil and O'Reilly GL-5 Gear lubrication. The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which described how the criteria specified in paragraphs (f), (g) and (h) will be met.

1910.1200(f)(5)(i): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the hazardous chemicals(s) contained therein:  a. On or about April 22, 2013, at the above located workplace, employees were required to use O'Reilly Diesel engine oil from a 150 gallon container when servicing semi-trucks. The container was not marked with the appropriate identity of the chemical. Employees were thereby exposed to the hazards associated with the chemical.

(Electronic access, microfiche, and other alternatives to maintaining paper copies of the material safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.)  a. On or about April 22, 2013, at the above located workplace, employees required to service semi-trucks were exposed to hazards associated with chemicals such as, but not limited to, use O'Reilly Diesel engine oil and O'Reilly GL-5 Gear lubrication.
