29 CFR 1910.95(i)(5): The employer did not ensure proper initial fitting and supervise the correct use of all hearing protectors:  Southeast Culvert, Inc. - on or about April 26, 2013, employees wore ear plugs due to high noise levels in the plastic manufactring facility and metal manufacturing facility, but did not use them correctly.  Ear plugs were observed protruding from the ear of several employees.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1200(f)(5): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged, or marked with the identity and appropriate hazard warnings regarding the chemicals contained therein:   Southeast Culvert, Inc. - on or about April 26, 2013, containers of diesel fuel were not labeled as to the contents and the hazards associated with them.  The CSHO observed abatement of this hazard during the inspection. Abatement Observed: YES

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  Southeast Culvert, Inc. - on or about April 26, 2013, employees used half face air purifying respirators and filtering facepiece respirators when welding.  Use was voluntary, but employees had not trained on information contained in Appendix D of the Respiratory Protection standard.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

Use was voluntary, but the employer did not perform medical evaluations or ensure that employers cleaned, stored, and maintained respirators properly.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
