29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface were not used. Crossbraces were used as a means of access: (a) In Front of the New Gym Addition - Three employees worked power washing from the level of the fourth buck on the four-buck high fabricated frame scaffold. The attachable ladder for accessing the scaffold only extended to the level of the third buck, so employees climbed the crossbraces to go between the level of the third buck and the level of the fourth buck, exposing the employees to a fall of 26 feet to the ground below, on or about April 23, 2013. No abatement certification or documentation required. (b) In Front of the New Gym Addition - An employee who made adjustments to the power washer, located on the level of the second buck of the fabricated frame scaffold, climbed the crossbracing to move from the level of the fourth buck down to the level of the second buck. Then, this employee climbed the end frame of the scaffolding to move from the second buck to the third buck and then from the third buck to the fourth buck, exposing this employee to a fall hazard ranging from 12 feet to 20 feet to the ground below, on or about April 23, 2013. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity: (a) In Front of the New Gym Addition - Three employees worked power washing from the four-buck high fabricated frame scaffold. A competent person did not inspect this scaffold at the start of the work shift. The scaffold had the following visible defects: the attachable ladder for accessing the scaffold only extended to the level of the third buck, so employees climbed the crossbraces to go between the level of the third buck and the level of the fourth buck; the second section in from the east on the level of the fourth buck had a severely bent top rail and mid rail; the eastern end of the second buck had no guardrail; and the eastern end of the third buck had only an unsecured pallet leaning across it. All of these defects exposed employees to a hazard of falling to the ground below, on or about April 23, 2013. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

The employee worked at the eastern end of the second buck, which had no guardrail, and at the eastern end of the third buck, which had only an unsecured pallet leaning across it, exposing the employee to a hazard of falling to the ground below, on or about April 23, 2013. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
