29 CFR 1926.95(a): "Application." Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. a. On April 22, 2013, at the above addressed jobsite, an employee cutting masonry blocks was not wearing a respirator, thereby exposing the employee to the hazards associated with silica.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part: a. On or about April 22, 2013, at the above addressed jobsite, an employee performing masonry operations from a tubular welded frame scaffold, eleven (11) feet one (1) inch above the ground, was exposed to injuries from falls due to the lack of guardrails.
