OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were expose to combustible polymer dust deflagration, explosion or other fire hazards while working at or near an indoor dryer/mixer and two indoor media-type dust collectors that were not adequately designed to prevent or minimize employee exposure in the event of deflagration or other fire event: (a) Dry Sift Room, Polymer Process: On or about April 23, 2013, the indoor Foreburg dryer/mixer and hopper handling combustible polymer dust lacked means of (1) explosion protection (2) fire protection and (3) deflagration isolation to connected downstream process equipment and the Dynamic dust collector. (b) Dry Sift Room, Polymer Process: On or about April 23, 2013, the indoor Dynamic dust collector (media-type) handling combustible polymer dust lacked means of (1) explosion protection (2) fire protection and (3) deflagration isolation to connected upstream process equipment and the unit's collection drums. (c) Dry Sift Room, Polymer Process: On or about April 23, 2013, the indoor Donalson Torit dust collector (media-type) handling combustible polymer dust lacked means of (1) explosion protection (2) fire protection and (3) deflagration isolation to upstream employee workstation location and unit's collection drum.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets. a. On or about April 23, 2013, employees required to work in the Dry Sift Room, the employees were not trained in the hazards associated with chemicals such as, but not limited to, combustible polymer dust.
