OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while operating an overhead underhung crane hoist with a tied-back safety latch: a) On April 23, 2013, at the worksite where employees were exposed to struck-by hazards while using an overhead underhung crane whose hook had a safety latch that was non-functional due to it being tied back with duct tape. The employer failed to ensure that periodic inspections were being performed by an operator or qualified person for missing or defective/non-functioning equipment/parts.
